What is the penalty for not filing Form 1040?

The failure-to-file penalty is 5% of any unpaid tax per month, up to a maximum of 25%. A separate failure-to-pay penalty of 0.5% per month applies to any tax not paid by the original deadline. Filing on time, even if you cannot pay the full balance, avoids the larger of the two penalties.
